H-1B updates · as of September 2026

What changed recently, in plain English.

H-1B rules moved quickly this year. Ask us how these changes affect your specific situation.

Weighted lottery

Registrations now receive entries by offered wage level: Level IV gets four, Level III three, Level II two and Level I one. Wage-level strategy matters more than before.

$100,000 fee blocked

A federal court vacated the $100,000 payment requirement in June and the appeals court declined to pause that ruling. The proclamation was extended to September 2027, but the fee is not currently being enforced.

Consular vs. change of status

How a petition is filed now affects cost and risk. We map out whether to request a change of status or consular processing for each case.
